Citizenship through marriage: Requirements and timeline

Taking the final step toward U.S. citizenship is a milestone that represents security, belonging, and a permanent home for your family. While the legal journey can feel like a mountain of paperwork, it is essentially a celebration of your commitment to your spouse and your future in this country. The three-year rule for spouses of U.S. citizens

Most permanent residents must wait five years before applying for naturalization, but as the spouse of a U.S. citizen, you may be eligible in just three years. To qualify for this accelerated path, you must have been a Lawful Permanent Resident (Green Card holder) for at least 36 months and have been living in «marital union» with your U.S. citizen spouse for that entire duration. It is a beautiful way the law recognizes the stability and deep roots you have planted through your marriage.

Beyond the time requirement, your spouse must have been a U.S. citizen for the entire three-year period. It is also important to show that you have been physically present in the United States for at least 18 months out of those three years. We often help clients document this continuity of residence, ensuring that any brief trips abroad don’t accidentally reset your clock or complicate your eligibility for this special marital provision.

Essential requirements: more than just a marriage certificate

Beyond the calendar, USCIS looks for «good moral character» and a basic understanding of the English language and U.S. civics. While the word «test» can feel intimidating, the naturalization interview is simply a conversation to confirm you are ready to participate fully in American civic life. We encourage our clients to see this not as a barrier, but as a formal welcome into the rights and responsibilities that come with being a citizen.

You must also prove that your marriage is «bona fide,» meaning it was entered into for love and a shared life, not just for immigration benefits. Even though you already proved this for your green card, you will need to provide updated evidence of your shared life, such as joint bank accounts, leases, or birth certificates of children born during the marriage. Providing a clear, organized picture of your life together makes the officer’s job easier and helps your interview go smoothly.

The naturalization timeline: from form N-400 to the oath

The first step of the naturalization process is to file an N-400 form with the U.S. Citizenship and Immigration Services (USCIS). You may file this application within 90 days of completing three years as a lawful permanent resident (LPR) and give yourself a «jump start» on the naturalization process. 

Once the form is filed, you will receive a receipt notice, and your biometrics appointment will be scheduled. At the appointment, your fingerprints and photograph will be taken to perform a standard background check. It may take several months for your application to be processed due to the current volume of applications at federal agencies, but once your application has been processed, you will be scheduled for an interview at your local USCIS office. At that time, an officer will review the application and administer the civics and English tests, the final «hurdle» before being granted citizenship. 

Upon being approved, you will participate in the Oath of Allegiance ceremony, at which time you will turn in your green card and receive your naturalization certificate, officially making you a United States citizen.
